The DEA has since moved to reschedule marijuana, but a new effort to block the shift is gaining traction in Congress. In April, Congressman Dana Rohrabacher (R-Calif.) introduced the Rohrabacher-Farr Amendment, which aims to block the government from rescheduling marijuana as a Schedule I drug. But that’s not the only attempt to stall the process. Next week, the House Judiciary Committee is expected to take up legislation aimed at blocking the DEA’s rescheduling efforts. And on Wednesday, the House Appropriations Committee will consider a measure that would prevent the Department of Justice from spending money to reschedule marijuana. The Rohrabacher-Farr Amendment passed through the House Judiciary Committee on April 26 with a 19-11 vote. The bill, which was sponsored by Reps. Sam Farr (D-Calif.) and Dana Rohrabacher (R-Calif.), passed the full committee on May 4 by a 16-10 vote. In both cases, House Democrats and Republicans agree that marijuana should be rescheduled from its current position as a Schedule I drug. The measure would prevent the DEA from rescheduling marijuana as a Schedule I drug until a final judicial decision has been made. But in both committees, the Democratic members outnumbered their Republican counterparts. And some Democrats worry that a partisan vote could be used to block the DEA from moving to reschedule marijuana, even though the DOJ supports rescheduling.
